Terms of use
The terms for using this site, together with the boundaries that keep Domaciel's launch services clear, advisory, and appropriately scoped.
Agreement to these terms
These Terms of Use govern your access to and use of domaciel.com (the “Site”). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
You must be at least 18 years old and able to enter into a binding agreement to submit a consultation inquiry. These Terms apply only to the Site; any paid advisory engagement will be governed by a separate written agreement.
Domaciel’s advisory scope
Domaciel provides lifestyle, product-research, and design-intent advisory services concerning water, air, materials, and restorative spaces in the home. The Site introduces that approach and allows prospective clients to request a conversation.
Website content is general information, not a recommendation for a particular residence. A consultation inquiry does not create a client relationship, reserve availability, or obligate either party to proceed. An engagement begins only when Domaciel and the client enter into a separate written agreement.
Professional boundaries
Domaciel does not, through this Site or its launch advisory services:
- Provide medical advice, diagnosis, treatment, or individualized health claims;
- Perform laboratory testing, environmental certification, or property inspection;
- Provide architecture, engineering, code review, or legal advice;
- Perform construction, installation, remediation, or regulated trade work; or
- Guarantee health, environmental, contaminant-reduction, equipment, or product-performance outcomes.
Information on the Site is not a substitute for advice from an appropriately qualified physician, laboratory, inspector, architect, engineer, attorney, or other licensed professional.
Construction and installation
Domaciel's launch services are advisory only. Domaciel does not provide or oversee contractor bids, arrange trade schedules, supervise construction, sell or bundle installation, collect payment for third-party installation, or hold itself out as a licensed contractor.
Clients independently select and contract directly with the laboratories, designers, vendors, and appropriately licensed contractors responsible for testing, technical design, professional plans, permits, installation, code compliance, schedules, warranties, and construction. A Domaciel design-intent brief must be reviewed and validated by the applicable qualified professional before purchase or installation.
Third-party products and professionals
The Site may discuss product categories, reference third-party information, or link to websites we do not control. Availability, specifications, certifications, pricing, warranties, and performance claims may change. You should confirm material information with the manufacturer, certifying body, seller, or qualified professional before relying on it.
Domaciel is not responsible for third-party websites, products, statements, services, workmanship, acts, or omissions. A reference or link does not create a warranty or imply that a third party is acting for Domaciel.
Your responsibilities
When using the Site or considering information from Domaciel, you agree to:
- Provide accurate, current information in your inquiry;
- Avoid submitting medical records or other sensitive information through the public form;
- Evaluate recommendations in light of your residence, household, budget, and maintenance preferences;
- Confirm technical, safety, certification, permitting, and installation requirements with the responsible qualified professional; and
- Use the Site only for lawful purposes and without disrupting its security or operation.
Intellectual property
The Site's writing, visual design, graphics, photographs, illustrations, brand elements, and other original content are owned by Domaciel or used with permission and are protected by applicable intellectual-property laws. You may view and print a reasonable copy for personal, noncommercial use. You may not reproduce, republish, sell, scrape, distribute, or create derivative commercial materials from Site content without prior written permission.
Site availability and disclaimers
We may change, suspend, or discontinue any part of the Site. While we aim to keep Site information useful and current, the Site is provided on an “as available” basis. To the fullest extent permitted by law, Domaciel disclaims warranties concerning the Site's uninterrupted availability, completeness, accuracy, or fitness for a particular purpose.
Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded, including applicable consumer rights.
Limitation of liability
To the fullest extent permitted by law, Domaciel will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of, or inability to use, the Site or reliance on general Site content. This limitation does not apply where liability cannot lawfully be limited or excluded. Liability arising from a paid advisory engagement, if any, will be addressed in the separate written agreement for that engagement.
Privacy
Our Privacy Notice explains how we handle information submitted through the Site. Please review it before sending an inquiry.
Changes and governing law
We may update these Terms to reflect changes to the Site, our services, or applicable requirements. The effective date above identifies the current version. Your continued use of the Site after an update means the revised Terms apply to your later use.
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except where another law must apply.
